While it is a victory for New Yorkers […] <!-- .archive-list-item --> <h2>How did NJ sports betting become legal?</h2> <p>The launch of NJ sports betting signaled the end of a legal battle spanning nearly a decade. The trouble stemmed from the state’s efforts to pass sports betting legislation starting around 2009. The ensuing court case pitted former NJ Gov. Chris Christie against the five largest US sports leagues — the NCAA, NBA, NFL, NHL, and MLB. Newly elected Gov. Phil Murphy replaced Christie on the docket when he took office in 2018.</p> <p>On the one side, NJ argued that sports betting should be a matter of states’ rights under the Tenth Amendment. On the other, the leagues cited the Professional and Amateur Sports Protection Act (<a href="http://www.onlinegamblingsites.com/law/paspa/" target="_blank" rel="noopener">PASPA</a>) of 1992 as grounds to prohibit state-regulated sports betting. NJ went ahead and passed its sports betting bill in 2012, and the leagues promptly filed an injunction.</p> <p>The state lost its initial District Court battle, then two more in the Third Circuit Court of Appeals — one before a group of three judges and another “en banc” hearing before the full panel. Each of those rulings went in the leagues’ favor, leaving NJ just one last avenue for potential relief. The state appealed to the US Supreme Court. In a surprise move, the nation’s highest judicial body agreed to hear oral arguments from both sides in December 2017. That alone was a small win, as SCOTUS takes up just a tiny fraction of the cases presented to it.</p> <p>The decisive victory came on May 14, 2018, when SCOTUS decided broadly in favor of New Jersey, striking PASPA down in full. The 6-3 majority decision was penned by Justice Samuel Alito. You can read the full text of the SCOTUS opinion <a href="https://www.supremecourt.gov/opinions/17pdf/16-476_dbfi.pdf" target="_blank" rel="noopener">here</a>. Less than a month later, Murphy signed an updated NJ sports betting bill into law <a href="https://www.legalsportsreport.com/21121/new-jersey-governor-signs-sports-betting-into-law/">on June 11, 2018</a>.</p> <h3>Licensing and taxes in NJ</h3> <p>When SCOTUS opened the door for individual states to legalize sports betting in May 2018, New Jersey was one of the first states to jump into action. Murphy signed off on legislation in June, and he also placed the first legal bet in the state just a few days later.</p> <p>The passage of legislation opened the doors for the state’s casinos and racetracks to have physical sportsbooks onsite. Online and mobile betting gained official approval later that summer. You can place wagers on professional and college sports, with the exception of college games taking place in the state or involving in-state programs. Betting on high school sports and esports is also prohibited under NJ law. No <a href="https://www.legalsportsreport.com/integrity-fee/">integrity fees</a> were included in the legislation, but it did specifically outline how the state would handle taxes on betting.</p> <ul><li>Casinos pay 8.5% on land-based wagers and 13% on electronic wagers.</li> <li>Racetracks are subject to the same, plus an additional 1.25% on electronic wagers.</li> <li>All US sports bets are also subject to federal taxes of 0.25%.</li> </ul><p>The casinos and racetracks can have up to three mobile skins operating off their license, which costs $100K at issue. Internet gambling licenses carry a price tag of $400K as well as an additional $250K for responsible gambling fees. The initial cost has been far from a deterrent, as the biggest names in the legal sports betting industry have all set up shop in the state.</p> <h2>Sports betting apps in NJ 2021</h2> <p>With up to three brands per licensee in New Jersey, the market in the state is expected to be one of the largest in the US. Here is how all the online operators in the state compare:</p> <h3>888 Sportsbook</h3> <p>The new 888 Sportsbook is the most recent extension of the partnership between gaming giant 888 and casino giant Caesars. The duo has been offering NJ online gambling for years, and Caesars’ casino license carries the permit for 888’s online platforms in the state.</p> <h3>Bet365</h3> <p>A major player in the global gaming scheme, Bet365 first touched down in NJ via a retail sportsbook partnership with Hard Rock Casino in Atlantic City in 2019. The company followed that up with the launch of its own online book in partnership with Playtech in August 2020.</p> <h3>BetAmerica Sportsbook</h3> <p>BetAmerica debuted its online sportsbook in NJ in early February 2019, just in time for the Super Bowl. The sportsbook is powered by SBTech and gained access to the market off of the Golden Nugget license. BetAmerica is a member of the Churchill Downs Inc. family, a company with a number of casino and racetrack properties under its umbrella. It will eventually be rebranded as TwinSpires.</p> <h3>BetMGM Sportsbook</h3> <p>The BetMGM app has been available as an NJ online casino for quite some time, formerly as PlayMGM, but it picked up some new features. A software update revealed a sportsbook baked into the existing app, providing an all-in-one gambling platform under a single account. BetMGM Sportsbook is an Entain product operating under the license of Borgata, which also offers retail sports betting on property.</p> <h3>Borgata Sportsbook</h3> <p>Borgata made history as the first Atlantic City sportsbook to accept a legal sports wager in June 2018, and the retail sportsbook operation has been significantly upgraded since then. Part of the MGM family, Borgata Sports launched its online and mobile sports betting platform in the Garden State in May 2019.</p> <h3>DraftKings Sportsbook</h3> <p>The two largest daily fantasy sports sites were among the first to enter the NJ sports betting industry. DraftKings Sportsbook was created under a partnership with Kambi and became the first legal online option for NJ bettors when it launched in August 2018. The platform operates under a partnership with Kambi (until its migrated to SBTech) and the casino license of Resorts AC.</p> <h3>Caesars Sportsbook</h3> <p>Caesars began to reveal its plans for NJ sports betting in July 2018, announcing a partnership with Scientific Games. The group opened two retail sportsbooks in Atlantic City in mid-summer, and the online/mobile platform went live immediately prior to the 2018 NFL season kickoff.</p> <h3>FanDuel Sportsbook</h3> <p>FanDuel Sportsbook is the product of an acquisition by Flutter Entertainment and a network of partnerships that includes IGT. The platform became the state’s fourth online sportsbook when it launched in September 2018, just in time for football season. The FanDuel Group also operates the retail sportsbook at The Meadowlands, which carries its online gaming permit, and Bally’s Casino.</p> <h3>FOX Bet Sportsbook</h3> <p>A sister site to FanDuel, FOX Bet is a product of a partnership between The Stars Group and FOX Sports. TSG is now a part of Flutter, and it has a long-standing partnership with Resorts Casino AC. In September 2019, the group deployed its newly acquired FOX Bet brand into the US market alongside its existing PokerStars NJ and Stars Casino products.</p> <h3>Golden Nugget Sportsbook</h3> <p>A physical sportsbook opened at the Golden Nugget casino in Atlantic City in July 2018, but the online and mobile launch took some time. In partnership with SBTech, the company launched its app the following February. On the casino side, the online offering from Golden Nugget is a market leader in NJ.</p> <h3>Hard Rock Sportsbook</h3> <p>Hard Rock partnered with GIG to bring sports betting to the property with the ubiquitous brand. The sportsbook is a smaller player in the market and works in tandem with an attached online casino. Hard Rock Hotel & Casino opened on the boardwalk in June 2018, but sports betting didn’t arrive on site (or online) until 2019.</p> <h3>PointsBet</h3> <p>PointsBet is an Australian company that arrived in New Jersey sports betting market in early 2019. It partnered with Meadowlands Racetrack for its first foray into the US. In addition to more traditional markets, its main selling point is a unique form of a high-risk, high-reward feature that it calls points betting.</p> <h3>Resorts Sportsbook</h3> <p>The final of the three mobile sportsbook licenses available to each NJ casino became the self-branded app for Resorts Sportsbook. Resorts partners with DraftKings Sportsbook and FOX Bet to account for the other two skins under the casino’s license.</p> <h3>SugarHouse Sportsbook</h3> <p>SugarHouse Sportsbook became the third legal option when it launched in late August 2018. It’s another combo platform, rolled into the existing NJ online casino website/app under a new tab. The unified product allowed customers to use a single account across all gambling verticals. SugarHouse Sportsbook relies on a partnership with Kambi. However, it splits its online gambling license between two properties: Monmouth Park for sports betting and Golden Nugget for online casino.</p> <h3>theScore Sportsbook</h3> <p>Media company theScore entered the New Jersey market with high hopes of converting a massive user base from its media app into sports betting. While that progress has been slower than hoped, theScore remains a bit of a sleeping giant in the state. The company is partnered with Bet.Works for its app.</p> <h3>Tipico Sportsbook</h3> <p>Tipico, a recognized market leader in Germany, made its US debut with a launch in NJ in December 2020. The company gained market access off of a second skin deal with Ocean Casino Resort in Atlantic City. Tipico has headquartered its US operations in Hoboken and has plans in the works for expansion into other states, including Colorado.</p> <h3>Unibet Sportsbook</h3> <p>Unibet, part of the Kindred Group, is a big name in global gaming circles. Its first US online sportsbook debuted in NJ in September 2019 off of its deal with Hard Rock Casino, and it has since launched in other states. Kambi is its US tech partner and powers the Unibet platform.</p> <h3>William Hill Sportsbook</h3> <p>William Hill could become a dominant supplier for US sports betting. It provides services for multiple properties in NJ including Ocean Casino, Tropicana, Caesars, and Monmouth Park, all of which share licensing in the state. It’s also worth noting that William Hill operates sportsbooks in every other state with legal wagering. Its online/mobile platform was created in-house.</p> <h3>WynnBet Sportsbook</h3> <p>WynnBet debuted its mobile sportsbook and casino offering in NJ in August 2020. The company, best known for its iconic casino properties in Las Vegas, gained access to the market via a deal with Caesars. Behind the scenes, WynnBet is powered by BetBull Limited.</p> <h2>Sports betting deals in NJ</h2> <p>In a number of legal states, there has been a growing trend of <a href="https://www.legalsportsreport.com/sports-betting-deals/">sportsbooks teaming up with local sports teams</a> for promotions. It’s another means of capturing attention in competitive markets, and a method that can prove to be quite effective. Here in New Jersey, there’s just a single pro team bearing the state’s name in the New Jersey Devils, but both the New York Giants and New York Jets play home games at MetLife Stadium in East Rutherford. While its close proximity to NYC has certainly helped, there’s also an ingrained gambling culture in the state via its lengthy history with casinos and racetracks. It will be interesting to see how long New Jersey can stay atop the charts as additional states come online with legal betting.</p> <h2>Which NJ casinos have sportsbooks?</h2> <p>In the wake of the US Supreme Court decision in May 2018, operators were quick to act in the Garden State. Monmouth Park Sportsbook by William Hill accepted the first legal wager the following month. Today, you can find a retail sportsbook at each of the operating NJ casinos and racetracks. The majority of casino sportsbooks are in Atlantic City.
